DPS Worldwide Express, essential data Unless otherwise agreed in writing by an authorized officer of DPS Worldwide Express, by using DPS Worldwide Express’s services, you, the Shipper, agree that the Terms and Conditions will be applicable from the moment DPS Worldwide Express accepts the Shipment on behalf of you and anyone else with an interest in the Shipment.

 

Shipment refers to any papers or packages that are transported under a single waybill and that are transported by whatever mode of transportation that DPS Worldwide Express determines, such as air, ground, or any other carrier. Any label created by DPS Worldwide Express automated systems, a waybill, or a consignment note, together with these terms and conditions, will be referred to as a waybill. As stated below, each shipment is carried with limited liability. At an extra expense, insurance may be set up if the shipper needs more security. For more details, please refer to the section below. Any member of the DPS Worldwide Express Network is referred to as DPS Worldwide Express

 

1. Imports, exports, and customs
To offer its services to the Shipper, DPS Worldwide Express may carry out any of the following tasks on the Shipper’s behalf:

(1) fulfill all legal requirements, including completing documentation, revising product or service codes, and paying taxes and duties;

(2) serve as the shipper’s forwarding agent for export control and customs clearance, and

(3) act as the receiver for the exclusive purpose of designating a customs broker to handle customs clearance and entry and, upon request from any person that DPS Worldwide Express reasonably believes to be authorized, reroute the shipment to the recipient’s import broker or another address.

(4) If the consignee refuses to pay, the shipper will be charged for any duties, taxes, and warehouse fees at the destination or origin customs (if the items are returned to the origin). The destination country’s customs policy and the shipping network determine all duty and taxes as well as warehouse charges. Duty and taxes are not the responsibility of DPS Worldwide Express

(5) According to DPS Worldwide Express, the shipper must submit two or three official proofs of address and a photo ID; if the shipper does not submit these documents, the shipment will be held and cannot be connected to the forwarding network or cleared for customs.

(6) Should a cargo be held up or halted by origin or destination customs for any reason, the shipper or consignee must present all necessary documentation and information, as well as appear in person at customs (should DPS Worldwide Express recommend to the sender). If a package is held up or stopped by customs, DPS Worldwide Express is not responsible for it.

 

2. Inacceptable Shipments
The shipper acknowledges that the shipment is acceptable for transportation and that it will be considered unacceptable if any of the following apply: it contains counterfeit goods, animals, bullion, currency, banderols/tax stickers, bearer form negotiable instruments, precious metals, and stones; real or imitation firearms, parts thereof, weapons, explosives, and ammunition; human remains, pornography or illegal narcotics/drugs); the shipment is not declared as hazardous material, dangerous goods

 

Note: DPS Worldwide Express has the right to hold any shipment that contains any restricted, forbidden, or undeclared goods (without providing any information). If necessary, DPS Worldwide Express will also forward the case to the relevant Indian legal regulatory body (narcotics, local police, or related department).

 

3. Deliveries and Undeliverable

Postal codes and P.O. boxes cannot accept deliveries. Not always to the designated Receiver in person, shipments are delivered to the address provided by the shipper (which, in the case of mail services, shall be assumed to be the first receiving postal service).

Deliveries made to addresses with a central reception area will go to that location. In the event that the shipment is judged unsatisfactory, undervalued for customs purposes, the recipient cannot be reasonably located or identified, the recipient refuses delivery, or the recipient refuses to pay for delivery, DPS Worldwide Express will make a good faith effort to return the shipment to the shipper at the shipper’s expense. If this isn’t possible, the shipment may be released, disposed of, or sold by DPS Worldwide Express or a related forwarding network or agency, without incurring any liability on the part of the shipper or third parties. The proceeds will be applied towards service charges and related expenses, such as destination duty and taxes, warehouse charges, and destroy charges, which the shipper will be billed to and will be required to pay.

 

4. Examining
Without prior warning, DPS Worldwide Express is entitled to open and inspect a shipment. If a shipment is subject to a physical inspection by the appropriate regulatory agency at both the origin and destination customs, DPS Worldwide Express shall not be held liable.

 

5. Transportation Fees
Shipment prices for DPS Worldwide Express are determined by using the greater of the actual or volumetric weight; in order to verify this computation, DPS Worldwide Express reserves the right to reweigh and remeasure any shipment. In addition to any claims, damages, fines, or other costs incurred if the shipment is judged unsuitable for transportation, the shipper is also responsible for paying or reimbursing DPS Worldwide Express for all shipment charges, ancillary charges, duties, and taxes due for services rendered by DPS Worldwide Express or incurred by DPS Worldwide Express on behalf of Shipper, Receiver, or any third party. If there is a claim, the shipper may go to the Claim Section of the claim policy.

 

6. Liability of DPS Worldwide Express

With highly skilled executives, DPS Worldwide Express is working nonstop to give customers a unique and accommodating service. Expert executives will be provided by the company for the pickup of the goods and for all transportation needs up until delivery. Note: The pickup executive is in charge until the shipment is picked up. After the shipment is picked up from the shipper, the shipper must call any DPS Worldwide Express office or branch office with any questions. The Pickup Executive is not liable for any inquiries or concerns.

 

7. Claims Time Limits
If claims are not received in writing (verbal communication is not acceptable), DPS Worldwide Express will not be held responsible. Claims must be submitted in writing to DPS Worldwide Express within three days of the shipment’s acceptance or, if the shipment is not forwarded or connected, within three days of the pickup. All claims must be made from the authorized shipper with an AWB copy. If the shipment is delivered, don’t forget to collect a delivery network complaint number. When the shipper provides the delivery network complaint number, all delivered shipment complaints will be accepted. Note: Only claims from approved shippers will be accepted.

 

8. Shipment Insurance
If the shipper fills out the insurance section on the front of the waybill, requests DPS Worldwide Express, and pays the relevant premium, DPS Worldwide Express will arrange insurance for the shipper covering the actual cash value in respect of loss of or physical damage to the shipment. Delayed shipments or indirect losses or damages are not covered by shipment insurance.

 

9. Shipments That Are Delayed
Though these are not promised and are not a part of the contract, DPS Worldwide Express will use all reasonable efforts to deliver the Shipment in accordance with DPS Worldwide Express’s usual delivery timetables. DPS Worldwide Express disclaims all liability for any losses or damages resulting from delays. Every delivery.

 

10. Events Outside of DPS Worldwide Express’s Authority
For any loss or damage resulting from events outside of DPS Worldwide Express’s control, DPS Worldwide Express disclaims all liability. These include, but are not limited to any act or omission by a person not employed or contracted by DPS Worldwide Express, such as a shipper, receiver, third party, customs, or another government official; Force Majeure – such as earthquake, cyclone, storm, flood, fog, war, plane crash or embargo, riot or civil commotion, industrial action; any defect or characteristic related to the nature of the shipment, even if known to DPS Worldwide Express.

 

11. Global Accords
The Montreal or Warsaw Conventions, as applicable, apply if the shipment is transported by air and includes a final destination or stop in a nation other than the country of departure. The Convention for the International Carriage of Goods by Road (CMR) may be applicable to international road transportation. These agreements restrict DPS Worldwide Express’s responsibility for any harm or loss.
If repackaging is necessary to import or export a shipment, we will do it without informing the shipper or consignee of the additional weight and repackaging fees.

 

12. Shipper’s indemnity and warranties
The shipper agrees to pay and hold DPS Worldwide Express blameless for any loss or damage resulting from the Shipper’s breach of the following warranties and representations, as well as from the Shipper’s failure to comply with any applicable laws or regulations:

The shipper or its agents have furnished accurate and comprehensive information.
The personnel of the shipper arranged the shipment in a secure location.
Reliable personnel were hired by the shipper to prepare the shipment.
During preparation, storage, and delivery to DPS Worldwide Express, the shipper safeguarded the shipment against unauthorized interference. The shipment was packed, labeled, and addressed appropriately to guarantee safe transportation with standard handling precautions.
I have complied with all applicable import, export, customs, and other laws and regulations.

 

13. DPS Worldwide Express

If the shipment is misrouted, delayed, or returned to the shipper, DPS Worldwide Express will not be held liable. The entire cost of return/address

The shipper shall pay for any correction, remote delivery, custom duty, and taxes (in the event that the consignee declines to pay).

 

14. DPS Worldwide Express reserves the right to change the forwarding network and repack the shipment as required without any prior notice to the shipper. For any reason, if the shipment is not forwarded by DPS Worldwide Express, the shipper will have to collect it from the local branch as advised. DPS Worldwide Express is not responsible for returning the shipment to the primary shipper in any case.
The Routing Shipper agrees to all routing and diversion, including the possibility that the Shipment may be carried via intermediate stopping places. If the shipment will be routed under the direction of the shipper/consignee then all the routing and address correction charges will be debited to the shipper as per DPS Worldwide Express.

 

15. Overarching Law Shipper irrevocably submits to the non-exclusive jurisdiction of the courts and the laws of the country of origin of the shipment for the benefit of DPS Worldwide Express with regard to any dispute arising under or in any manner related to these Terms and Conditions, unless otherwise prohibited by law.

 

16. Return shipping guidelines
If the shipment is returned to the shipper after being picked up by the shipper, DPS Worldwide Express will not guarantee a timely return; instead, the shipper must pick it up from the closest DPS Worldwide Express branch once the shipping processing and pickup fees have been subtracted. DPS Worldwide Express will offer free warehousing service for 15 days following the date of pickup if the shipper sends the package by that time. Following that, or if the shipper chooses not to send the package, the following warehouse/storage fees will be charged starting on the day of pickup:

Manpower charges, Cancellation Charges, Processing Charges, Labour Charges, Any other charges decided by company at the time of cancellation ( Non Negotiable).

 

Note : If shipment returned to sender than all above charges payable by shipper { A+B+C+D) GST Extra on Total billing.

DPS Worldwide Express, all agreements & services also provided that all the disputes shall be subject to Delhi jurisdiction only.
